"As it pertains to being a real estate
agent, I have a fiduciary relationship with my clients and principals through
the law of agency that requires me to protect and promote their interests as I
would my own; including guarding their negotiating position at all times and
disclosing all known facts which may affect or influence their decisions. Agents also have the duty to disclose all
remuneration to their principals. Hidden or secret fees are simply not
permitted.
A fiduciary duty is the highest
standard of care at either equity or law and is based upon a legal or ethical
relationship of trust between two or more parties. A fiduciary is expected to
be extremely loyal to the person to whom he owes the duty (the "principal”
and must not put his personal interests before the duty, and must not profit
from his position as a fiduciary, unless the principal consents.)"
